This Digital Millennium Copyright Act (“DMCA”) Policy explains how GetGulfVacancy.com (“we”, “us”, or “our”) handles notices of alleged copyright infringement and counter-notifications. Scope of This Policy

How to Submit a DMCA Notice (Takedown Request)

To request removal or disablement of access to material you believe infringes your copyright, your notice must include the following information as required by 17 U.S.C. § 512(c)(3):

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works at a single online site are covered by one notice.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and information reasonably sufficient to permit us to locate the material (e.g., full URL(s) of the specific page and a description of the content).
  • Contact information for the complaining party, such as full name, mailing address, telephone number, and email address.
  • A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

Incomplete notices may delay our response or be returned for clarification.

Counter-Notification Procedure

If we remove or disable access to content in response to a DMCA notice, the user who posted the content may send a counter-notification. To be valid under 17 U.S.C. § 512(g)(3), a counter-notification must include:

  • A physical or electronic signature of the subscriber.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled (e.g., the exact URL).
  • A statement under penalty of perjury that the subscriber has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • The subscriber’s name, address, and telephone number, and a statement that the subscriber consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or, if outside the United States, to the jurisdiction of any judicial district in which GetGulfVacancy.com may be found, and that the subscriber will accept service of process from the person who provided the original DMCA notice or an agent of such person.

Our Response to Notices

  • Upon receipt of a valid DMCA notice, we will expeditiously remove or disable access to the identified material.
  • We may notify the user who posted the content so they can submit a counter-notification if they choose.
  • If we receive a valid counter-notification, we may restore the material within 10–14 business days unless the original complainant informs us that a court action has been filed seeking to restrain the user from engaging in infringing activity.
  • We may refuse notices or counter-notifications that are incomplete, fraudulent, or submitted in bad faith.

Repeat Infringer Policy

In appropriate circumstances, and at our discretion, we may suspend or terminate access for users who are determined to be repeat infringers. We also reserve the right to remove content and disable accounts for other violations of our Terms and Conditions.

Misrepresentation and Abuse

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material or activity is infringing may be liable for damages, including costs and attorneys’ fees, incurred by us or our users. Do not misuse the DMCA process.

Privacy of Notices

Notices and counter-notifications may include personal data. By submitting a notice or counter-notification, you consent to our sharing this information with the affected user, legal counsel, service providers, and relevant authorities as necessary to process the claim, comply with law, or protect our rights. Do not include more personal information than is necessary.
